📋 The short version: Use PerformX lawfully, don't abuse the platform, pay for what you use, and we'll keep building you the best coaching tool in sport. If something goes sideways, these terms spell out how we handle it.
1. Acceptance
By creating an account or using PerformX ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you're using PerformX on behalf of an organisation (club, academy, institution), you represent that you have authority to bind that organisation.
If you don't agree, please don't use the Service. No hard feelings.
2. Who Can Use PerformX
- You must be at least 13 years old.
- If you are between 13 and 18, you must have parental or guardian consent.
- You must provide accurate registration information and keep it up to date.
- One account per person — no sharing credentials.
3. Your Account
You're responsible for keeping your account credentials secure. You agree to notify us immediately at legal@performax.coach if you suspect unauthorised access. We're not liable for any loss arising from your failure to protect your login details.
4. Subscriptions & Billing
- Coach accounts are currently free — we reserve the right to introduce paid coach tiers in future with reasonable notice.
- Athlete subscriptions are billed monthly or annually via Stripe.
- Club Plans are billed centrally and managed via a separate agreement.
- Subscriptions automatically renew unless cancelled before the next billing date.
- Refunds are provided at our discretion for billing errors. We don't offer refunds for partial subscription periods unless required by applicable consumer law.
5. Acceptable Use
You agree not to:
- Scrape, reverse-engineer, or attempt to extract source code or model weights from the platform.
- Upload content that is illegal, abusive, defamatory, or infringes third-party rights.
- Use PerformX to facilitate doping, cheating in competitions, or any activity that violates sports governing body rules.
- Resell or sublicense access to the platform without written permission.
- Attempt to overwhelm our infrastructure (DDoS, abuse of AI endpoints, etc.).
- Impersonate another coach or athlete.
Violation of these rules may result in immediate account suspension without refund.
6. Your Content
You retain ownership of the training data, session plans, notes, and other content you upload ("Your Content"). By uploading it, you grant us a limited licence to store, process, and display Your Content solely to provide the Service to you.
We don't claim ownership of your training programs. Your intellectual property is yours.
7. AI Features
PerformX uses AI to generate training insights, session summaries, and coaching recommendations. These are informational only — they are not a substitute for professional coaching judgement or medical advice. You assume responsibility for how you act on AI-generated suggestions.
8. Availability & Changes
We aim for 99.5% uptime but don't guarantee it. We may modify, suspend, or discontinue features with reasonable notice. We won't discontinue the core platform without at minimum 30 days' notice.
9. Disclaimer of Warranties
PerformX is provided "as is" and "as available." To the extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose. Athletic performance improvement is not guaranteed — training is inherently uncertain (as any good coach knows).
10. Limitation of Liability
To the fullest extent permitted by law, our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or AUD $100, whichever is greater.
We are not liable for indirect, incidental, special, or consequential damages — including lost performance, missed competitions, or overtraining injuries (please listen to your body).
11. Termination
You can delete your account any time from Settings. We may suspend or terminate accounts that violate these Terms. Upon termination, your access ends and we'll delete your data per our Privacy Policy.
12. Governing Law
These Terms are governed by the laws of Victoria, Australia. Disputes shall be resolved in the courts of Victoria, unless consumer protection laws in your jurisdiction require otherwise.
13. Changes to These Terms
We'll notify you of material changes via email or in-app notice with at least 14 days' notice before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
